Jose De Jesus E. Rizo, 27, of the 3400 block of McCormick Avenue, was driving Saturday near McCormick and Redwood avenues and missed a turn at the corner, losing control of the moped and causing it to skid, according to a probable cause affidavit.
Two children were thrown from the moped when it crashed. Both children, who were not related to Rizo, received cuts over their head, face and body, court papers said. Neither of the children was wearing a helmet or eye protection. The children’s ages were not released.
Police said Rizo’s blood-alcohol content at the scene was 0.24 percent – three times Indiana’s legal limit of 0.08 percent.
Rizo was charged with two felony counts of neglect of a dependent, two felony counts of operating a vehicle while intoxicated and a single misdemeanor charge of operating a vehicle while intoxicated.
He posted $2,500 bond Monday evening and was released from jail.
